1.0. ACCEPTANCE OF TERMS

1.1. This website is operated by FUEGO®. Throughout the site, the terms “we”, “us” and “our” refer to FUEGO®. We offer this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

1.2. This policy is a legally binding document, and forms part of the contract of sale between you and us made under our terms and conditions of sale. You can review the most current version of the Terms of Service at any time on this page.

1.3. By visiting our site and/or purchasing something from us, you engage in our service and agree to be bound by the following terms and conditions including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

1.4. Please read these Terms and Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

1.5. Any new features or tools which are added to the current store shall also be subject to the Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of, or access to the website following the update of any changes constitutes acceptance of those changes.

1.6. You must be over the age of 16 to use the FUEGO® website. By creating an account through our site, you confirm that you adhere to these terms and any other personal information you provide is true. We reserve the right to refuse any of our services and to terminate your account and any agreement with you at any time without notice. If we determine you have provided false or misleading information, violated or abused any terms of this agreement or are in breach of applicable laws then our right to refuse and/or terminate will be administered.

2.0. DELIVERY

2.1. As part of the FUEGO® commitment to delivery, we will deliver worldwide. If the delivery address of your order is a UK mainland address, then you will be able to select your method of delivery and tracking, comprehensively provided by Royal Mail. If the address for delivery of your order is not a UK mainland address, then you will be able to select worldwide shipping options from our aforementioned courier.

2.2. Shipping will be made to the delivery address indicated by you, the customer. Please see our shipping services section on our Delivery and Returns page for more information regarding scheduling, holidays, and other time-sensitive delivery periods. We also aim to deliver your order by the estimated date stated in the shipping confirmation email, or, if no estimated date is given, within 14 days of the date of the shipping confirmation email.

2.3. If delivery is delayed for any reason within our control, we will do our best to keep you informed about the new estimated delivery date. If the order has been shipped, assigned a tracking number and is still delayed, this is out of our control. Please note that if your order is not delivered within 21 days of the shipping confirmation email, you are entitled to cancel the order and be refunded the full amount paid for the undelivered products.

2.4. Delivery charges are at the discretion of FUEGO®. We expect delivery charges to remain consistent all year round, however during holiday periods (e.g. Black Friday, Christmas, etc.) a surcharge may be, but not expected to be, added on express and guaranteed delivery options.

2.5. Delivery failure: If an item cannot be delivered (due to an incorrect address, non-collection etc.), an email will be sent to you, the customer. The item will then be kept by FUEGO® for 30 days. If the item is not claimed from FUEGO®, or if no address update is provided to FUEGO® within the above-mentioned timescale of 30 days, the item will be refunded back to the customer’s method of payment. In the event that the refund cannot be fulfilled, FUEGO® will become the owner of the item.

3.0. PRODUCT

3.1. The prices of the products will be as quoted on the site at the time you submit your order. We take all reasonable care to ensure the prices of products are correct at the time when the relevant information is entered onto the site. Prices for our products may change from time to time, but changes will not affect any order you have already placed. The price of a product includes VAT (where applicable).

3.2. If the price in which you have paid for your product changes within the duration of a potential refund, rest assured you will receive the full monetary amount in which you paid at the time of order, via the same method of payment.

4.0. PAYMENT

4.1. Payment is required at the time of purchase and placement of your order. Payment is charged/debited at the end of the complete check-out process. You will not be charged prior to the final step and can choose not to proceed at any time before payment is taken.

4.2. If using credit services such as Klarna or Clearpay, FUEGO® will retain title to the products you order until you have made payment in full for those products. All risk in the products will pass to you upon their delivery to or collection by a postal or courier service. You should consider whether you need to obtain any suitable insurance.

5.0. GIFT CARDS

5.1. FUEGO® Gift Cards are valid for 1 year from the issue date, or until no amount remains on the FUEGO® Gift Card. Any balance that remains on the FUEGO® Gift Card after expiry will not be available for use. FUEGO® Gift Cards cannot be exchanged (wholly or partly) for cash, reloaded, topped up or used to purchase other gift cards.

5.2. FUEGO® Gift Cards are partially redeemable, and any unused balance can be used for future purchases up to the expiry date. FUEGO® Gift Cards should be treated like cash. Lost or stolen gift cards will not be replaced or refunded.

5.3. Items purchased using FUEGO® Gift Cards that are subject to our returns or refunds policy will be refunded as store credit. We reserve the right to issue you with a new FUEGO® Gift Card equivalent to the value of your refunded gift card purchase. Should we suspect any fraud relating to a FUEGO® Gift Card, we may refuse to redeem the gift card until we are satisfied that no fraud has occurred.

6.0. REFUNDS

6.1. Please read the returns policy for refund details. Our returns policy outlines the circumstances that a refund will be available to you. This can be found on our Delivery & Returns page. Refunds do not include the delivery and/or packaging cost.

6.2. FUEGO® will in no way be liable for any direct, indirect, incidental, special or consequential damages. FUEGO® also do not offer a repair service of any kind therefore if you find a product within your order arrives damaged or faulty, you will be eligible for a full refund within 60 days of your shipping date.

6.3. FUEGO® carefully inspects every product returned to us as faulty, for damage, tailoring or other alterations made to the garment or accessory. It is under our discretion whether to accept faulty goods after inspection and should the refund not be granted; the product will be sent back to you at your cost of delivery. FUEGO® will reimburse any delivery charges for approved inspections of faulty goods. FUEGO® reserves the right to refuse any legitimately faulty goods after the period of 60 days. After the allotted time frame, the product will be classed as wear and tear.

7.0. PRIVACY & DATA PROTECTION

7.1. We collect and use your personal information as described in our Privacy Policy. By using our website and services, you consent to the collection and use of your information as outlined in the Privacy Policy.

7.2. We will never sell or share your information with third parties. You may be asked to input information about yourself on this website. We take your privacy seriously, and your personal information will always be treated in accordance with our Privacy Policy.

7.3. FUEGO® carries out activity to protect you, and our interests, from fraudulent orders and payments. If FUEGO® determines an order is potentially fraudulent, we will not dispatch goods until we are satisfied that cardholder identification has been achieved and our Fraud Protection Process has been completed.

8.0. COPYRIGHT

8.1. All content displayed on this site, including (but not limited to): all text, graphics, logos, names and trademarks (collectively, “Our Content”) is the property of FUEGO® and is protected by copyright, trademark and other intellectual property laws.

8.2. Except as permitted by the UK Copyright Act 1988 no part of the website or Our Content may be reproduced, adapted, performed/presented in public or transmitted in any form by any process without the specific prior written consent of FUEGO®.

9.0. GENERAL

9.1. If an account is permanently deactivated for reasons covered in our terms, any current orders will not be affected. The affected user will retain limited access to their account until those ongoing transactions are completed.

9.2. Acceptable use policy: Users shall not develop or use any third-party applications that interact with the FUEGO® platform without FUEGO®’s prior written consent, including any scripts designed to scrape or extract data from the FUEGO® platform.

9.3. FUEGO® has not reviewed all the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by FUEGO®. Use of any such linked web site is at the user's own risk.
